You agree to the terms of service below, and the Terms of Use for Substack, the technology provider.

These Terms of Service govern your access to and use of Profits Over Prophets, including its website, emails, posts, notes, comments, and related features (the “Publication”). The Publication is operated by The Trading Initiative, located in Washington, United States (“TTI,” “we,” “us,” or “our”).
By accessing, subscribing to, or interacting with the Publication, you agree to these Terms and to the terms and policies that apply to the Substack platform. If you do not agree, do not use the Publication.
1. Relationship to Substack
The Publication is hosted on Substack. Your use of Substack is also governed by Substack’s Terms of Use, Privacy Policy, and other applicable platform policies. These Terms govern your relationship with TTI concerning the Publication. They do not replace Substack’s terms.
2. Educational content only
The Publication provides general educational information, market commentary, opinions, and entertainment. Nothing in the Publication is personalized investment, financial, legal, tax, or accounting advice. Nothing is an offer, solicitation, or recommendation to buy, sell, or hold any security, commodity, digital asset, financial instrument, or investment strategy.
Accessing or interacting with the Publication does not create an investment adviser, broker, fiduciary, advisory, client, or professional relationship between you and TTI, Hamilton, or any contributor.
3. Trading and investment risk
Trading and investing involve substantial risk. You may lose some or all of the money you commit, and certain products or strategies may expose you to losses greater than your initial investment. Leverage, options, futures, short selling, digital assets, and other complex instruments involve additional risks and may not be appropriate for everyone.
You are solely responsible for your decisions, research, risk management, and compliance with laws that apply to you. Consider consulting appropriately licensed professionals who understand your circumstances before making financial decisions. Past performance does not guarantee future results.
4. Opinions, accuracy, and changes
Content reflects the author’s opinions at the time it is published. Those opinions may change without notice. Markets move quickly, and information may become incomplete, delayed, or outdated. Although we try to be thoughtful and accurate, we do not promise that any content, data, chart, quotation, link, or analysis is complete, current, or error free.
TTI and contributors may hold, buy, sell, or otherwise have an interest in assets discussed in the Publication. A discussion of an asset does not mean that any person will take the same action or maintain a position for any particular period.
5. No warranties
The Publication is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, TTI disclaims all express and implied warranties, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, title, noninfringement, and uninterrupted availability.
6. Third party content and separate TTI services
The Publication may discuss, quote, embed, or link to third party content, social media posts, data sources, products, and services. A reference or link does not constitute an endorsement, and we are not responsible for third party content, availability, security, or privacy practices.
The paid TTI community, its research, education, trade ideas, memberships, and any other TTI products are separate services. Subscribing to Profits Over Prophets does not enroll you in the TTI community or create a paid membership. Separate terms and privacy practices apply when you independently sign up for those services.
7. Intellectual property
Unless otherwise stated, the original content of the Publication is owned by TTI or used with permission and is protected by intellectual property laws. You may read, download, and share links to publicly available posts for personal, noncommercial use. Brief excerpts may be quoted with clear attribution and a link to the original.
You may not reproduce, republish, sell, license, remove attribution from, or commercially exploit a substantial portion of the Publication without prior written permission.
8. Comments and community conduct
You are responsible for content you submit through comments, replies, notes, or other community features. Do not post unlawful, abusive, deceptive, infringing, harassing, confidential, or spam content. We may moderate, restrict, or remove content and may limit access to community features when reasonably necessary to protect readers, the Publication, or TTI.
9. Limitation of liability
To the fullest extent permitted by law, TTI, Hamilton, contributors, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, trading losses, investment losses, or damages arising from your reliance on or use of the Publication.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
10. Suspension and termination
You may unsubscribe at any time. We may suspend or terminate access to the Publication or its community features when reasonably necessary for legal, safety, security, abuse prevention, or policy enforcement reasons. Provisions that by their nature should survive termination will remain in effect.
11. Changes to these Terms
We may update these Terms as the Publication or applicable requirements change. The current version will appear on this page with an updated effective date. Material changes may also be communicated through the Publication when appropriate. Your continued use after an update means you accept the revised Terms, to the extent permitted by law.
12. Governing law
These Terms are governed by the laws of the State of Washington and applicable United States federal law, without regard to conflict of law principles. Any dispute that is not subject to a mandatory forum under applicable consumer law will be brought in a court of competent jurisdiction in Washington.
