This Privacy Policy explains how The Trading Initiative, located in Washington, United States (“TTI,” “we,” “us,” or “our”), handles personal information in connection with Profits Over Prophets, including its website, emails, posts, notes, comments, and related features (the “Publication”).

1. Scope and relationship to Substack

The Publication is hosted on Substack. Substack processes personal information for its own platform purposes as described in the Substack Privacy Policy. When Substack processes subscriber and reader information on our behalf, Substack generally acts as a service provider or data processor and TTI acts as the controller of the Publication’s subscriber list.

This Policy describes TTI’s practices concerning the Publication. It does not replace Substack’s Privacy Policy or govern information you provide when you separately join the paid TTI community or use another TTI service.

2. Information we receive

Depending on how you interact with the Publication, we may receive:

• Subscriber and profile information: your email address, name, Substack handle, profile details you make available, subscription status, and subscription dates.

• Engagement information: email opens, link clicks, page views, referral sources, approximate location, and other audience statistics that Substack makes available to publishers.

• Communications: information you include when you reply to an email, contact us, answer a survey, or request support.

• Community activity: comments, replies, notes, reactions, reports, and other information you choose to submit through Substack features.

• Imported subscription information: if you previously subscribed through another email platform, including Kit, we may lawfully transfer your email address and subscription information to Substack so we can continue the subscription you requested. You may unsubscribe at any time.

Substack collects technical, account, cookie, device, and usage information as described in its own Privacy Policy. We do not receive your full payment card information from Substack or its payment providers.

3. How we use information

We use personal information to:

• Deliver the Publication and manage subscriptions.

• Communicate with readers and respond to requests.

• Understand engagement and improve our writing, distribution, and reader experience.

• Operate and moderate comments, notes, and other community features.

• Protect the Publication, TTI, Substack users, and others from spam, abuse, fraud, security threats, and unlawful activity.

• Comply with legal obligations and establish, exercise, or defend legal rights.

Where applicable law requires a legal basis, we rely on your request to receive the Publication, your consent, our legitimate interests in operating and improving the Publication, and compliance with legal obligations, as appropriate.

4. Substack only unless you separately join TTI

Subscribing to Profits Over Prophets does not enroll you in the paid TTI community. We do not transfer the PoP subscriber list to Circle or add subscribers to the TTI community database merely because they subscribe to this Publication.

If you independently sign up for the TTI community or another TTI service, the information you provide through that separate signup will be handled under the terms and privacy practices presented for that service.

5. How information may be disclosed

We may disclose personal information:

• To Substack and its service providers as needed to host, deliver, secure, analyze, and support the Publication.

• To professional advisers or vendors who need the information to provide services to us and who are subject to appropriate confidentiality or data protection obligations.

• When reasonably necessary to comply with law, legal process, or a valid government request, or to protect rights, safety, security, and the integrity of the Publication.

• In connection with a merger, financing, acquisition, reorganization, or sale of all or part of TTI, subject to applicable law and appropriate protections.

• At your direction or with your consent.

We do not sell or rent the Publication’s subscriber list. We do not sell personal information or share it for cross context behavioral advertising. We do not intentionally submit subscriber email addresses, private replies, or other subscriber personal information to generative AI tools.

6. Cookies and analytics

Substack uses cookies and similar technologies and provides publication analytics as described in its Privacy Policy. We use the audience and engagement analytics available through Substack. We do not currently add our own third party advertising pixels to the Publication. If that changes, we will update this Policy as appropriate.

7. Retention

We retain personal information for as long as reasonably necessary to operate the Publication, fulfill the purposes described here, comply with law, resolve disputes, protect security, and honor unsubscribe or suppression requests. Substack controls retention for information it processes for its own purposes.

8. Your choices and rights

You may unsubscribe from publication emails at any time using the unsubscribe link in an email. You may also manage your Substack account, subscriptions, comments, and profile through Substack.

Depending on where you live, you may have rights to request access, correction, deletion, restriction, objection, or portability of personal information, or to withdraw consent. You may also have the right to appeal or complain to an appropriate data protection authority. We will respond to verified requests as required by applicable law and will not discriminate against you for exercising an applicable privacy right.

9. International processing

TTI and Substack are based in the United States. Personal information may be processed in the United States or other countries where Substack and its service providers operate. Substack describes its international transfer mechanisms and safeguards in its Privacy Policy and Publisher Agreement.

10. Security

We take reasonable administrative and operational steps to protect personal information and rely on Substack’s platform safeguards for information hosted there. No method of transmission or storage is completely secure, so absolute security cannot be guaranteed.

11. Children

The Publication is not directed to children under 16, and Substack’s terms do not permit children under 16 to use the platform. We do not knowingly collect personal information from children under 16. If you believe a child has provided personal information, contact us so the matter can be addressed.

12. Changes to this Policy

We may update this Policy as the Publication, our practices, or applicable requirements change. The current version will appear on this page with an updated effective date. We may also provide additional notice of material changes when appropriate.
